PARTICIPANT AGREEMENT FORM

Whereas the Hill Country Antique Tractor & Engine Club, Inc., (The Club) sponsors an annual Hill Country Antique Tractor & Engine Club Show (The Show), which involves vendors, exhibitors, workers and volunteers; and

Whereas The Club is desirous of being indemnified and held harmless and making certain agreements as hereinafter provided;

Now, therefore, for and in consideration of the mutual covenants and promises contained in The Agreement and for such good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged and confessed, The Participant hereby agrees as follows:

The Participant (exhibitor, worker, volunteer, or vendor) shall observe and comply with all Club, state, federal and local laws, rules, regulations and ordinances applicable to The Participant, including without limitation the protection of the environment and/or the handling and disposal of waste and hazardous substances, public health and safety and fire codes.
The Participant shall, at his own cost and expense, obtain all necessary permits, licenses, authorizations and assurances required by federal, state or local laws, rules, regulations or ordinances in order to allow participation at the show.
The Participant acknowledges that he has inspected the space or grounds to be utilized by The Club in sponsoring The Show, that he is satisfied with its physical condition and its suitability for its intended use and that he accepts such space or grounds in its existing condition.
The Participant understands and acknowledges that The Show may contain certain hazards common to an event of this type and that The Club has taken reasonable and prudent care to provide a safe environment. The Participant herein certifies that he is knowledgeable and experienced in participating in such an event.
The Participant agrees to indemnify, defend, keep and save harmless The Club, its members, officers, directors, agents, employees, representatives, successors and assigns, from and against all losses, costs, damages, expenses, suits, claims or liabilities of any kind whatsoever arising out of or related to, directly or indirectly, the conduct of The Participant, or anyone else or with regard to any event or happening at The Show.
The Participant acknowledges and agrees that The Club, its members, officers, directors, agents, employees and representatives, shall not be liable for any damage to the goods, wares, merchandise or other property of The Participant, its employees, invitees, customers, subcontractors or any other persons, nor shall The Club, its members, officers, directors, agents, employees or representatives be liable for injury to The Participant, his employees, agents, vendors, contractors, subcontractors or others. The Participant waives any and all claims against The Club for all such damages or injury.
The Participant shall not assign his rights or delegate his duties hereunder.
This Agreement shall be governed as to performance and interpretation in accordance with the laws of the State of Texas, and parties agree that venue over any causes or controversies arising under of from The Agreement shall lie in a court of competent jurisdiction in Gillespie County, Texas.

In witness, The Participant has caused this Agreement to be signed as of the date hereof. (Note: All adults in The Participant's party must sign).

ADDENDUM TO THE PARTICIPANT AGREEMENT FORM

This Addendum is made a part of The Participant Agreement executed by The Participant in the named annual Antique Tractor & Engine Club Show.

Whereas The Participant wishes to have his or her minor child or legal ward drive a tractor in an EDGE&TA-sponsored event and said minor child or legal ward is at least sixteen years old and has a valid driver's license or learner's permit or has completed an EDGE&TA Youth Driver Training Program and passed EDGE&TA's Operational Safety Tests.

Whereas The Participant attests to the competence and safety of said minor child or legal ward's tractor-driving skills;

Therefore, The Participant agrees to accept full and sole responsibility for all action of said minor child or legal ward and agrees to indemnify, defend, keep and save harmless The Club, its members, officers, directors, agents, representatives, successors and assigns, from and against all losses, costs, damages, expense, suits, claims or liabilities or any kind arising out of or related to, directly or indirectly, any incident involving said minor child or legal ward arising from said minor child or legal ward's participation as a tractor driver during the named annual Antique Tractor & Engine Club Show.
